Data Collection When Writing a Comment
When commenting on an article or post, we collect your personal data (name, email address, comment text) only to the extent you provide. Processing serves the purpose of enabling commenting and displaying comments.
By submitting the comment, you consent to the processing of the transmitted data. Processing is carried out on the basis of Art. 6 (1) lit. a GDPR with your consent. You may revoke your consent at any time by notifying us, without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal. Your personal data will subsequently be deleted.
When your comment is published, the name you provided and the email address you communicated will be published.
In addition, when submitting a comment, your IP address is stored for the purpose of preventing misuse of the contact form and ensuring the security of our information technology systems.
By submitting the comment, you consent to the processing of the transmitted data. Processing is carried out on the basis of Art. 6 (1) lit. a GDPR with your consent. You may revoke your consent at any time by notifying us, without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal. Your IP address will subsequently be deleted.
Customer Account
You can register with ParkingList or create a customer account when booking. In the customer account we store your contact details (name, email address), your bookings, the vehicles you have saved and, if you create one, a billing profile with company name, VAT ID and address. We also store the time of your registration, the time and number of your logins, the account view you have selected and your settings for marketing emails and the travel reminder.
This processing serves to provide your bookings, vehicles and billing details in one place and to make future bookings easier. The legal basis is Art. 6 (1) (b) GDPR (contract for the use of the customer account). If you request an invoice in your account, we transmit your email address, the booking details and your billing profile to the provider of the booked parking space, who issues the invoice.
You can request the deletion of your customer account at any time via our contact page or by email to [email protected]. Data that we must keep because of statutory retention periods will be deleted once these periods have expired (see “Duration of Storage”).
Collection, Processing, Use and Processing of Personal Data for Orders
When placing an order, we collect and use your personal data only insofar as this is necessary for the fulfilment and processing of your order and for handling your enquiries.
The provision of data is necessary for the conclusion of the contract. Failure to provide data means that no contract can be concluded.

Your data will not be passed on to third parties without your express consent. In all cases, we strictly observe the statutory requirements. The scope of data transmission is limited to a minimum.
Review Invitation via Trustpilot
After a booking via ParkingList we invite you by email to review ParkingList and the parking space you booked: shortly after the booking to review our service, and on the day after your return to review the parking space. For this purpose, when the booking is completed we transmit your name, email address, booking number and language, and for the parking space review additionally its name, image and link, to Trustpilot A/S, Pilestræde 58, 5, 1112 Copenhagen, Denmark, which sends the invitations on our behalf (processor, Art. 28 GDPR).
The legal basis is Art. 6 (1) (f) GDPR in conjunction with Section 7 (3) of the German Unfair Competition Act (UWG) (marketing to existing customers). You can object to the invitation at any time, see “Right to Object to Direct Marketing”. We will then no longer transmit your data to Trustpilot and will have invitation data already transmitted deleted. An invitation already scheduled for an existing booking may still reach you in individual cases. Submitting a review is voluntary.

Advertising for Similar Services (Existing Customers)
If you have booked a parking space via ParkingList, we use the email address you provided to inform you about our own similar services, such as parking at airports and ports, reminders before the travel season or add-ons such as cancellation protection. The legal basis is Art. 6 (1) (f) GDPR in conjunction with Section 7 (3) UWG; our legitimate interest is direct marketing to existing customers. We send no more than two such emails per year and use the address for this purpose for no longer than 24 months after your last booking. Apart from the review invitation via Trustpilot (see above), we do not pass your address to third parties for this purpose; our own mail server handles the technical delivery.
Travel Reminder (Consent)
If you activate the travel reminder, we send you an email before your next trip with offers for the airport or port of your last booking. To get the timing right we use the airport, travel dates and postcode of your last booking and the school holiday dates of your federal state. The legal basis is your consent, Art. 6 (1) (a) GDPR. We log the time, source and wording of your consent so that we can prove it. You can withdraw your consent at any time with future effect: via the link in every email, in your account or by emailing [email protected]. Without withdrawal, the reminder ends no later than 24 months after your last booking.
Right to Object to Direct Marketing
You may object at any time to the use of your email address for advertising, at no cost other than the transmission costs at basic rates (Art. 21 (2) GDPR, Section 7 (3) UWG): via the unsubscribe link in every marketing email, at www.parkinglist.de/secure/unsubscribe, by email to [email protected] or by post to ParkingList BW GmbH, Kantstraße 149, 10623 Berlin.
After an objection we add your email address to a suppression list and process it only to honour the objection permanently (Art. 17 (3) (b), Art. 21 (3) GDPR). Emails concerning your booking (confirmation, changes, reminder before arrival) will still be sent.

When a user visits a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is accessed again.

Partner and travel-agency referral (cookie „_pcode“)

For processing payments on our website, we use the payment service provider Stripe. ParkingList is an intermediary platform. The purchase contract is concluded between you and the respective parking provider, not with ParkingList BW GmbH. Accordingly, the amount you pay is not transferred to an account of ParkingList, but directly to the account of the respective parking provider. Payment processing takes place via the Stripe Connect function, in which Stripe acts as a technical service provider mediating between you as the payer and the parking provider as the payment recipient.
When you make a payment, the payment data you enter (e.g. credit card number, expiry date, security code, billing address) is transmitted directly to Stripe and processed there. ParkingList has no access to your complete payment data at any time.
The data processing serves the purpose of payment processing and fraud prevention. The processing is carried out on the basis of Art. 6(1)(b) GDPR, as the processing is necessary for the performance of a contract, as well as on the basis of Art. 6(1)(f) GDPR from the legitimate interest in secure and efficient payment transactions.
In the course of payment processing, Stripe may collect and process the following data: name, address, email address, IP address, telephone number, payment method information, as well as – for the purposes of fraud prevention – behavioural and device data. This data is also forwarded to the respective parking provider as the payment recipient, insofar as this is necessary for processing the payment transaction.
Your data may also be transferred to the USA. For data transfers to the USA, an adequacy decision of the European Commission (EU-US Data Privacy Framework) exists. In addition, Stripe uses standard contractual clauses pursuant to Art. 46(2)(c) GDPR as a basis for data transfers to third countries.

Use of YouTube
The provider uses the YouTube video embedding function on its website. This function is offered by YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066 USA ("YouTube"). Maps with Leaflet and OpenStreetMap
To show the location of parking spaces we use the open-source map library Leaflet, which we serve from our own server. The map tiles come from OpenStreetMap (OpenStreetMap Foundation, St John's Innovation Centre, Cowley Road, Cambridge CB4 0WS, United Kingdom). When the tiles are loaded, your browser transmits its IP address, technical browser data and the map sections requested to the OpenStreetMap servers.
Processing is carried out on the basis of Art. 6 (1) lit. f GDPR based on the legitimate interest in showing you the location of a parking space and its surroundings. On the overview and landing pages the map is only loaded once you open it or interact with the page; on the detail page of a parking space it is loaded together with the page. You have the right, on grounds relating to your particular situation, to object to this processing at any time.
For data transfers to the United Kingdom, an adequacy decision by the European Commission exists.

If you enter a place or address in the parking search that is not contained in our own place index, our server queries the search term with the OpenStreetMap service Nominatim in order to determine the corresponding coordinates. Only the search term and the IP address of our server are transmitted, not your IP address. We cache the responses for a short time in order to reduce the number of queries.
Duration of Storage
After complete contract processing, the data is initially stored taking into account statutory retention periods, in particular those under tax and commercial law, and then deleted after the expiry of the retention period, unless you have consented to further processing and use.
Rights of the Data Subject
If the statutory requirements are met, you have the following rights under Art. 15 to 20 GDPR: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability. To exercise your rights, an email to [email protected] is sufficient.
Right to object under Art. 21 GDPR
You may object at any time, on grounds relating to your particular situation, to processing based on Art. 6 (1) (f) GDPR. You may object at any time and without giving reasons to the processing of your data for direct marketing; we will then no longer process it for this purpose. Right to Lodge a Complaint with a Supervisory Authority
You have the right under Art. 77 GDPR to lodge a complaint with the supervisory authority if you believe that the processing of your personal data is not lawful.
